In pursuance of the Federal Law "On Communications" and the Law of the Russian Federation "On Protection of Consumer Rights", the Government of the Russian Federation, by its Resolution No. 1342 of December 9, 2014, approved the Rules for the provision of telephone services.

The rules regulate the relationship between the subscriber and (or) the user of telephone services and the communication operator in the provision of local, intra-zone, intercity and international telephone communication services in the public communication network, as well as in the provision of mobile radio communication services, mobile radio telephone communication services and mobile satellite services. radio communications in the public communications network.
In accordance with Articles 44 and 54 of the Federal Law "On Communications" on the territory of the Russian Federation, communications services are provided by communications operators to users of communications services on the basis of an agreement on the provision of communications services concluded in accordance with civil legislation and the rules for the provision of communications services approved by the Government of the Russian Federation; the procedure and form of payment for communication services are determined by the contract for the provision of communication services, unless otherwise established by the legislation of the Russian Federation; payment for local telephone connections is made at the choice of a citizen subscriber using a subscriber or time-based payment system.

A tariff plan is a set of price conditions on which a telecom operator offers to use one or more telephone services. Tariffs (tariff plans) are set for one or several telephone services; when they are formed, a subscriber payment system, a time-based payment system, and a combined payment system can be used.
The rules oblige the telecom operator at least 10 days before the change current tariffs for telephone services, notify subscribers about this through the website of the telecom operator in the information and telecommunications network "Internet". The arguments of the administrative plaintiff about the contradiction between the contested provisions of the Rules and the norms of the Civil Code of the Russian Federation are untenable.
The Civil Code of the Russian Federation does not allow unilateral refusal to fulfill an obligation and unilateral change of its conditions (paragraph 1 of Article 310).
In accordance with the Civil Code of the Russian Federation, termination of the contract is possible by agreement of the parties, while the agreement to amend or terminate the contract is made in the same form as the contract, and if the parties have not reached such an agreement, then at the request of one of the parties, the contract may be terminated by the court (paragraph 1 of Article 450, paragraph 1 of Article 452).
The contested provisions of the normative legal act correspond to paragraph 1 of Article 28 of the Federal Law "On Communications", according to which tariffs for communications services are set by the communications operator independently, unless otherwise provided by this Federal Law and the legislation of the Russian Federation on natural monopolies, and are not provided to the communications operator the right to unilaterally change the system of payment for telephone services agreed with the subscriber.
