To become a participant in government procurement as a supplier, you need to collect the required package of documents, submit an application and register on the portal https://v3bl.goszakup.gov.kz/ru/user/login.

Also, in order to sign an agreement with budgetary organizations, the company must be registered in the database of the Treasury Committee of the Republic of Kazakhstan as a director. Wherein this company should not be included in the register of unscrupulous suppliers.

- ID card of the first director of the company,
- certificate of a registered legal entity, indicating the BIN (available at egov.kz),
- an order for the appointment of a Director (the first head of the company), with the signature and seal of the company,
- company charter (all sheets required), signed and sealed,
- Application for obtaining an electronic signature (generated upon registration on the portal),
- certificate of availability of a bank account (issued by the bank, usually within 3 days),
- one-time power of attorney to receive digital signature**.

* A complete and up-to-date list of documents must be agreed upon with the customer or directly on the portal of the Treasury Committee of the Republic of Kazakhstan.

** Issued on behalf of the first manager (on company letterhead with a stamp and signature), if the supporting documents will be provided to the Public Service Center by an authorized person, and not by the head of the company. You also need the identity card of the most trusted person.

Important! If you already have EDS keys, but they were received before January 1, 2016, they will have to be reissued.

All registration actions can be divided into 2 parts - technical preparation and collection of documents.

Technical aspects of registration on the public procurement website

There are several options for solving this problem.

Install and configure NCA RK certificates.

Sign Workaround 18 is software necessary for authorization on the government procurement website and signing electronic documents. Step No. 2 - application for digital signature (public keys)

The online application is submitted on the website http://pki.gov.kz/index.php/ru/yuridicheskie-litsa/is-kaznachejstvo-klient, the “submit application” button at the bottom of the page.

When you click on the button, a window will appear with “ user agreement", which needs to be confirmed. Next, you will need to enter company information for verification.

During the filling process, the system will ask you to specify the key storage (Kaztoken, eToken, JaCarta, file system PKCS12). If you want to store keys on your computer, you need to select “file system (PKCS12)” and specify the path to a specific folder (for example, you can create a folder “EDS” on drive C and specify the path to it). The digital signature will be stored in this folder.

Step No. 3 - going to the Public Service Center and receiving digital signatures (private keys)

The previously generated application (in pdf format) must be printed, stamped and signed by the first manager of the company.

You will also need a one-time power of attorney to receive an electronic digital signature if the supporting documents are brought to the Public Service Center not by the head of the company himself, but by a person trusted by him, for example an accountant.

After confirmation of the provided documents at the Public Service Center, the public digital signature keys on your computer will “turn” into private ones. Usually within 1 hour.

As a result we get: EDS private keys automatically generated on your computer.

Step No. 4 - authorization and registration on the government procurement website

We go to the state website. procurement 2016 https://v3bl.goszakup.gov.kz/ru/user/login and click on the right top corner"login" button.

Next, click the “select a key” button and select a key in the window that appears AUTH(needed for authorization). Key GOST used as a signature. Both keys are located in the previously specified key storage (for example, the “EDS” folder on the C:\ drive).

Why do participants (suppliers) need to register on the unified information system website?

From the moment of adoption until 2018, only customers needed to register on the official government procurement website zakupki.gov.ru. But in December 2017, Federal Law-504 “On Amendments to Federal Law-44” was adopted. According to this law, from January 2019, procurement participants (contractors) will also need to register.

Until July 2018, they were carried out only electronically; today, customers can conduct electronic, requests, etc. Since 2019, all procurements have been transferred to electronic form, which is intended to ensure greater transparency.

Purchases in electronic format are carried out at approved sites, their list is determined by the Government of the Russian Federation.

Since everything has switched to electronic format since January 2019, the Unified Register of Procurement Participants has appeared in the UIS, which contains information about the supplier. The Federal Treasury will be responsible for its formation and maintenance.

As a result, registration in the Unified Information System is a mandatory procedure for everyone; without it, it is not possible to take part in auctions.

The supplier will initially be registered in the Unified Information System, and the accreditation of the participant on the electronic platform is carried out in automatic mode through information exchange.

Thanks to registration in the EIS, the supplier will be automatically accredited at all sites. However, the validity period of its accreditation will remain the same – 3 years. No earlier than six months before the expiration of accreditation, you will need to register for a new term.

When there are 4 months left before the end of registration, you will receive a notification requesting its extension for a new period. If the participant does not will be registered again, then three months before the expiration of its validity period he will be deprived of the opportunity to participate in the auction.

How to register in the EIS according to 44-FZ

According to Art. 24.2 44-FZ (came into force on January 1, 2019), registration of participants in the EIS and their accreditation will be carried out electronically based on information and submitted documents within the time frame determined by the Government of the Russian Federation.

Information about procurement participants who are registered in the Unified Information System is transferred to a single one. The Unified Register of Participants is a list of registered entrepreneurs, individuals and legal entities who can take part in public procurement. Such a register will be maintained from January 2019 by the Treasury, and the list will be posted on the website of the Unified Information System. It is intended to be placed in open access, and anyone can view it free of charge.

The procedure for registering suppliers in the Unified Information System after the beginning of 2019 will generally involve the following steps:

  1. The supplier undergoes the registration procedure in the UIS electronic.
  2. The EIS transmits information to electronic trading platforms.
  3. Operators trading platforms will have to accredit the participant no later than the next working day.
  4. Registration will last three years.

Charging fees for registration in the EIS and accreditation on the electronic platform is not allowed. But from July 2018, according to Government Decree No. 564 of 2018, electronic platforms will be able to charge a fee for participation in the electronic procedure. The maximum fee is set at 1% of (but not more than 5 thousand rubles). When concluding a contract for SMP, the maximum fee cannot exceed 1% of the NMCC (no more than 2 thousand rubles).

Participants who have previously been accredited for electronic platforms, can also register in the unified information system from January to December 2019. The possibility of such registration will be provided until the end of 2019.

Also in Federal Law-44, according to the new clause 13 of Art. 4, the concept of “independent registrar” will appear. It is created for the purpose of recording the actions and inactions of participants in a unified information system. His tasks include:

  1. Monitoring the availability of the site’s unified information system and storage of such information.
  2. Recording (including real-time video recording) of inaction or actions of participants in the field of procurement.
  3. Storing such information about the actions or inactions of participants contract system, including information about electronic documents that are generated by participants in the contract system and signed by them using an electronic digital signature.

List of required documents

The list of requested documents for registration in the Unified Information System is similar to that required for accreditation on the electronic trading platform. In particular, the supplier will need:

  1. Charter of a legal entity or passport of an individual entrepreneur.
  2. Extract from the Unified State Register of Legal Entities/extract from the Unified State Register of Individual Entrepreneurs for, which has a limited validity period (no more than six months before applying for registration).
  3. Documents confirming the authority of the manager(for example, an extract from the charter or an order on its appointment).
  4. Documents that confirm the owner's status(if the signature is not for the manager).
  5. Documents confirming the right to register in the UIS(power of attorney from the head of a legal entity or entrepreneur).
  6. Decision on approval of major transactions indicating the maximum transaction amount.

Registration procedure: step-by-step instructions

Registration in the Unified Information System must be carried out by all organizations that plan to participate in the system of state and municipal procurement. The general procedure for registering with the UIS is as follows:

  1. registration of an electronic digital signature of a qualified (enhanced) type(allows you not only to work in the Unified Information System by posting procurement plans and schedules, but also to carry out work on signing posted protocols of completed electronic trading procedures, as well as electronic contract forms). It is necessary in order to carry out all legal actions in the UIS. Simultaneously with the registration of the digital signature, information is entered into the Consolidated Register of Participants in Public Procurement. The presence of a participant in government procurement procedures in such a register allows for the implementation of various trade procedures.   2. registration of an authorized representative companies on the State Services website.
  3. direct registration in the EIS within your personal account. It is carried out in several stages and is carried out directly on the website zakupki.gov.ru.

The registration itself looks like this:

  • in the upper right corner information portal EIS should select the login option Personal Area (in the proposed menu you need to go to the personal account tab under 44-FZ);
  • personal account is registered to the head of the organization(since the initial work is carried out only with his qualified digital signature). The exception is cases when the authority to sign a particular contract is assigned to a special employee of the organization, to whom they are granted on the basis of a specially drawn up power of attorney;
  • when you first enter your personal account, the site functionality will prompt you to fill out the necessary information about the organization (all sections should be filled out only on the basis of official data contained in the Unified State Register of Legal Entities and the organization’s statutory documents);
  • registration of the head of the organization or a specially authorized person occurs as the administrator of the organization in the Unified Information System only after filling out all the necessary information about the organization;
  • the final stage is checking the issued EDS certificate , for which you will need to sign a special registration form.

The final login information (login and password) will be sent to the administrator to the email address specified during registration.

Error during IP registration

Nuances of registering suppliers in the EIS

The following nuances of registering suppliers in the UIS can be cited:

  1. Registration occurs in electronic format no charge.
  2. Information about the participant and the documents submitted by him will be entered into a single register.
  3. Registration is valid for three years, again this procedure made no more than six months before the end of registration.
  4. If there are up to three months left until the end of registration, the participant is not entitled on participation in new procurements.
  5. When registering, it is unacceptable to request information and documentation, not provided for by the Government of the Russian Federation.
  6. Registration of offshore companies in the EIS is not allowed.
  7. The list of documents for registration is specified in the Government Decree and additional information may not be requested.
  8. Procurement participants who have registered in the Unified Information System will be able to participate in all held on electronic platforms.
  9. Procurement participants who have been accredited but not registered in the EIS will be able to submit applications until the end of 2019. New procurement participants and those who have three months left until the end of their accreditation at the site will not be able to submit applications.

EDS and requirements for it

To register in the EIS, the participant will need a qualified electronic signature. Today, a non-qualified signature is not used for bidding.

The signature must be obtained from a certification center accredited by the Ministry of Telecom and Mass Communications. Reinforced digital signature created using special programs encryption that ensures the safety and immutability of information.

An enhanced signature confirms the authority of the signatory. It is used not only during registration, but also during the procurement process. EDS allows you to sign documents placed in the UIS.

The EDS certificate contains data such as the owner’s full name, name and details of the organization, EDS certificate number, details of the certification center and a unique key that allows you to verify the authenticity of the signature (on the State Services website).

Transition period

The new procedure for admitting participants to the EIS involves a transition period during which the following stages are planned:

  1. From July 2018 to January 2019 accreditation of procurement participants on electronic platforms for participation in tenders remains the same (in accordance with Part 49 of Article 112 of 44-FZ).
  2. From January 2019 participants on electronic platforms are accredited only after their registration in the EIS.
  3. Accreditation of participants on the ETP must be carried out after their registration in the EIS in accordance with Art. 24.2 44-FZ (part 48 of article 112 44-FZ).
  4. From January to December 2019 accredited participants on electronic platforms must register in the Unified Information System (under Part 47 of Article 112 of 44-FZ) to participate in electronic procedures.
  5. Until December 31, 2019 submission of applications for participation in the auction is carried out by persons accredited earlier than January 1, 2019 on the electronic platform. They will not need registration in the Unified Information System during this time frame under Part 50 of Art. 112 FZ-44. Except for those who have three months left until the end of their accreditation at the site.
  6. From January 1, 2020 Registration in the Unified Information System will become mandatory for everyone.

Thus, in 2018, participants in public procurement did not have to register in the Unified Information System. This requirement for them acquired legal force from January 2019, from that moment it ceases to apply old order accreditation in the contract procurement system. Until this point, participants had to be accredited on each of the 6 electronic trading platforms. From 2019, they will be automatically accredited based on the results of registration in the Unified Information System. Registration will take place electronically according to a similar algorithm with accreditation on the ETP. To register, a person must obtain an enhanced qualified electronic signature.

User registration in the UIS is carried out in strict accordance with a certain procedure approved by Order of the Treasury of Russia No. 27n dated December 30, 2015. The order itself consists of basic provisions that approve the regulations for registration procedures and responsible persons, and directly the procedure for registration in the Unified Information System in the field of procurement. The document establishes the registration procedure for the following categories of users:

  • Information Systems;
  • organizations whose information is included in the Consolidated Register;
  • authorized persons of these institutions;
  • legal entities and their representatives.

Order 27n also presents judicial practice aimed at resolving controversial issues related to the process of user authorization in the UIS.

If the customer was registered in the Unified Information System before Order No. 27n came into force, then he will have to re-register.

Step-by-step instructions for registering customers in the UIS

Step 3. To start the customer registration process under 44-FZ, you need to, and from there go to the “Personal Account” section.

The system will automatically redirect the new customer to the registration section of the organization or user in the UIS through the Consolidated List of Customers.

If the customer has already re-registered through the system public services- ESIA, then the Unified Information System will show such a notification.

Step 4. In order for the initial registration procedure of the customer to be successful, information about such an organization must be entered into the Consolidated Register indicating the roles of the institution in the Federal Contract System. As soon as a specialist starts registration, data from the Consolidated Register is automatically sent to the Unified Information System, after which an ICO is generated - the organization’s identification code.

On email customer specified in information map Consolidated register, a letter is received confirming the institution’s registration in the system.

In case of initial registration under 44-FZ for customer organizations from the Unified Consolidated Register Information system automatically registers a manager with appropriate authority. The registered manager's card will look like this:

Step 5. After successful registration, you must log in to the customer’s personal account in accordance with 44-FZ.

After entering the LC according to 44-FZ, the system will send a notification.

Step 6. The specialist must perform the “Login” action in Section III of Procedure 27n, after which he will be redirected to the registered manager’s personal account. A message about initial authorization will appear on the screen.

The registration procedure for the customer is now complete.

How can a customer register a user under 44-FZ

Authorized persons who must be registered in the Unified Information System to work with the Federal Contract System must also obtain and install electronic signature certificates on their PCs.

User registration under 44-FZ is available only to an authorized person with the “Organization Administrator” functionality.

Step 1. A specialist with such permissions in his personal account on the “Registered users of the organization” page must select the “Register user” action.

Step 3. Then fill out the registration form. You must fill in all required fields marked with a red asterisk.

Step 4. After entering the data, the specialist clicks “Register user”. The system checks for completeness and correctness of the entered data and, if there are no errors, sends a message about signing the registration form.

Step 5. After the administrator selects "Continue", New user will be registered.

How to register a customer under 223-FZ

Step 1. The first actions of a specialist of the customer organization included in the Consolidated Register are similar to working with the registration form under 44-FZ - you need to go to the main page of the UIS, and then to your personal account under 223-FZ.

Step 2. The user then selects Section III of Order 27n and performs the “Login” action.

Step 4. The specialist clicks “Continue” and is redirected to the identification and primary authorization section. The procedure for further actions is identical to the registration procedure under 44-FZ.

How to register a user under 223-FZ

Now we register a user who will work under 223-FZ.

Step 1. Registration is automatically performed for new customers under 223-FZ. If the institution's user is not found during initial authorization, the registration form opens.

Step 2. You need to check whether all information is filled out correctly. If the registration request is generated without errors, then the “Register” action is selected.

User rights and updating of data on Unified Identification and Logistics registers are established automatically.

Step 3. After completing the procedure, the user receives a message about successful registration under 223-FZ.

How the register of legal entities works under 223-FZ

From March 1, 2019, the standards of the Government of the Russian Federation No. 1711 of December 28, 2018 “On the procedure for maintaining a register of legal entities” came into force. The document regulates the rules for maintaining the register of legal entities registered in the UIS within the framework of 223-FZ (Part 2 of Article 1 of 223-FZ).

The register itself is a collection of data on registered legal entities indicating the following information about customers:

  • full or short name;
  • organizational and legal form;
  • address;
  • TIN, KPP, OGRN;
  • other information specified during registration.

To find the desired customer in the list, enter its name or registration codes - TIN, KPP, OGRN - into the search bar.

The list is maintained electronically in the Unified Information System by specialists from the Russian Treasury. If the customer organization's access is terminated under 223-FZ, information about it is excluded from the register within three working days.

The state, in order to systematize and prevent corruption, has created a single portal on which all public procurement is posted, and where all potential contractors are invited to take part in tenders.

In Russia, not all government procurements are required to be published on the website of the same name; secret procurements of the armed forces can be carried out in the format of a single supplier and are not required to be published. The basic law for public procurement is 44 Federal Law “On the contract system”.

Contest

Open competition

Today, the most common method of tendering for public procurement is an open competition. Based on the name, its essence is immediately clear, so almost anyone can submit documents for this competition, and information about this competition goes to various channels, primarily to the government procurement website.

Despite the great popularity of this tender, it is very bureaucratic; the minimum time for conducting this tender rarely becomes less than 1 month. An open tender can be held not only directly by the customer, but also by another person on his behalf.

In this competition, its documentation sets out in detail the subject, selection criteria, and competition procedure. Also, this competition has a peculiarity: if only one application is submitted for it, then they will be considered invalid, since the tender implies the participation of at least two persons competing with each other for the right to carry out this competition.

The procedure for holding an open tender itself, despite all its bureaucratic and drawn-out nature, is extremely simple: participants submit their proposals and prices in envelopes; at an open tender, the competition commission opens these envelopes and selects the most profitable proposition. Next, an agreement is formed with him, and a contract is concluded.

If the organization refuses to carry out the tender or it is impossible to reach an agreement between the parties, it is possible to conclude a contract with the person who took second place in the open competition.

Closed Competition

The procedural aspects of a closed competition are similar to an open one. But the entire closed competition has a significant difference; it consists in the fact that only those persons whom the customer himself invited to participate in the competition can take part in the closed competition. Since the competition is closed, the results are also not published.

Auction

Open auction

This auction is held via the Internet and accordingly is published on the government procurement portal, in the media, as well as on the official Internet portal of the customer conducting the open auction.

Notices of this auction in the listed sources must be published 20 days before the auction itself.

IN in some cases The law allows for the possibility of holding this open auction with the publication of information about it 7 days before it is held.

An open auction resembles trading at an auction, only if the price usually goes up, then in this case The winner is the person who ultimately offers the lowest price for completing the order.

During an open auction, participants make bids, first the first bid is made, after each round participants can make one bid, but by a certain percentage less than the previous one (usually this percentage is 0.5, that is, each subsequent person who wants to lower the bid is obliged to reduce the price by at least one two-hundredth).

The auction is considered completed when no one has made a bid by the end of the round. To participate in an open auction, you must provide your bid for this purpose; as a rule, each participant contributes 3 percent of the original order price.

Closed auction

Auctions, like competitions, can be open or closed. Only the difference between them is colossal, the only similarity is perhaps the names open and closed. The essence of open auctions is that each bidder sees the bids made by their opponents, and in closed auctions the opposite is that participants do not see the bids made.

Applications for participation are submitted with an envelope containing the price for which the participant is willing to complete the order; after all envelopes are opened, the lowest price is determined, and whoever offered this price automatically becomes the winner of the closed auction.

Notices regarding this auction are also published in the media and on the customer’s official website twenty days before the auction itself. It should also be noted that this form of order is especially popular in carrying out orders related to state secrets, which are a formally closed version.

The customer also checks the access to state secrets of organizations applying for the tender. Since this auction is held in a closed form, as you understand, the possibility of an excessive price reduction is less possible than in an open auction, this announces the possibility of holding this state tender.

Electronic auction

An open auction is the most modern of modern auctions; the procedure for its conduct is regulated by 94 Federal Laws. It is held on electronic platforms accredited by the government Russian Federation or the Ministry of Economic Development.

All notices about this competition are published on the government procurement website, as well as directly on the site itself where the electronic auction is held.

Today, all open auctions are required to be held in electronic format, that is, they are documented to be held, but the form is not defined, and later the legislator determined that open auctions can only be held in electronic form.

Before the end of the auction, only the moderator of the site knows who is participating in the drawing, which reduces corruption risks.

How to register on the website zakupki.gov.ru?
